Mental Health Parity Act – Final Rules

The Mental Health Parity and Addiction Equity Act (MHPAEA) Final Rules were released on November 13, 2013 and apply to health plans effective on or after July 1, 2014.

The Final Rules provide clarification on how the benefits for alternate care services under the mental health and chemical dependency rehabilitation benefits should be covered for the purposes of achieving parity. Alternate care benefits include partial hospitalization, day treatment and intensive outpatient programs.


The Final Rules did not change the general parity requirement or the rules for determining parity. MHPAEA requires that the financial requirements and treatment limitations of a benefit program’s mental health and chemical dependency benefits be ‘at parity’ with the predominant financial requirements and treatment limitations that apply to substantially all of that benefit program’s medical and surgical benefits in a given classification.

Health Net has reviewed all of the medical and mental health plans in each region, and will update plans as necessary upon renewal to comply with the Final Rules.
